'Twilight' Toiletries: Bath & Body Works Sues Summit Entertainment Over 'Lip Venom'

Twilight woods.jpg" style="margin: 5px; float: left; width: 200px; height: 303px;" />I know that everyone has been just dying to hear the latest news on the "Twilight" toiletry front, so here it is: Bath & Body Works is suing Summit Entertainment (the studio behind "Twilight") over a set of beauty products that the company sells.

If that sounds backwards to you, you're right. Bath & Body Works is reportedly under threat from Summit for the products, and is hoping for a declaratory judgement in their favor. In other words, they're sort of pre-suing before they get sued.

The products in question are the "Twilight Woods" set of toiletries from Bath & Body Works, which include scented candles, body mist and perfume, body wash, lotions, and a lip balm called "Lip Venom," which doesn't seem to be on the company's website anymore (perhaps they felt it really was a bit too close to "Twilight").

Summit is arguing that the products use the movie series' color palette which, combined with the name, make it seem as though the products are "Twilight" branded when they're really not. The argument seems weak, especially when considering that the "Twilight" books use a red, black, and white palette, and the movies just seem very gray and blue.

Bath & Body Works is setting up a defense through attack in their lawsuit, which states "The term 'Twilight' is used so as to evoke the idea of a particular time of day when the sun is just below the horizon, illuminating the landscape. Whereas defendant uses the term 'Twilight' to refer to defendant's teen vampire saga."
