UPDATE: Tom Cruise and Katie Holmes Getting a Divorce At Katie's Request

UPDATE: There's no question about it now, as Tom Cruise has released his own statement on the matter, claiming that Holmes is the one who filed for divorce and painting himself as being a bit shocked by the whole thing:

"Kate has filed for divorce and Tom is deeply saddened and is concentrating on his three children," reads the statement from Cruise's rep. "Please allow them their privacy to work this out."

Are Tom Cruise and Katie Holmes dunzo?

It's certainly looking that way: TMZ is reporting that the couple is on the verge of divorce, and comments from Holmes' lawyer aren't really doing much to refute the claim. The attorney released a statement saying, "This is a personal and private matter for Katie and her family. Katie's primary concern remains, as it always has been, her daughter's best interests."

As of now, there is no official statement from Holmes or Cruise on the matter, and no word on whether divorce papers have been filed or not. But when an attorney releases a statement like that, it's pretty clear that something is going on.

Cruise and Holmes have been married for five years, and have one child together in the much-publicized Suri. Cruise has been married twice before, once to Nicole Kidman, with whom he has two children.

Holmes appeared most recently in the Adam Sandler flop "Jack and Jill." Cruise has been busier than ever, meanwhile, having starred in "Mission: Impossible - Ghost Protocol" and "Rock of Ages" recently. He is currently shooting a new action sci-fi film called "Oblivion."
