Sofia Vergara's Embryo Battle Heats Up Again

Modern Family star Sofia Vergara has already won one legal battle with her ex over custody of their frozen embryos, but she's got another battle ahead of her. Her ex has once again filed a lawsuit to get control of the embryos, but Vergara has countered his legal argument.

Sofía Vergara and Nick Loeb’s legal battle over her frozen embryos is heating up for a third time.

Vergara is requesting that a lawsuit filed by Loeb, her ex, be thrown out of court, according to The Blast. Loeb filed the lawsuit in Louisiana in January, which is the second time he’s filed in the Southern state.

The “Modern Family” star, 45, claims she has no ties to Louisiana, so the suit should be tossed. Vergara also claims her ex-fiancé, 42, is trying to file his latest lawsuit under the guise of the Uniform Child Custody Jurisdiction and Enforcement Act, but she claims that doesn’t apply to pre-embryos.

Vergara scored a major victory in August 2017 when a Louisiana judge tossed the case. Loeb requested custody of the frozen embryos, claiming Vergara “effectively abandoned” them.

Loeb and Vergara broke up in 2014. They had two frozen embryos, and the terms of their arrangement required consent from both parties before they could be brought to term.
