Country Singer Mindy McCready Facing Jail Time if She Doesn't Return Son to Florida Courts Despite rumors and media reports to the contrary, there is no Amber Alert out on country singer Mindy McCready's 5-year old son Zander.

McCready does, however, have the boy despite not legally having custody of the child, and faces serious legal repurcussions (including possible jail time) if she does not return him to a court in Lee County, Florida by Thursday.

“I did not steal my child, as it would be impossible for me to kidnap what already belongs to me," McCready told Access Hollywood.

Florida authorities confirmed that McCready did, in fact, have the child, that he was safe, and that it was not yet considered a criminal matter.

“We had contact with her via Skype last night,” Cape Coral Police Lt. Tony Sizemore told The New York Daily News. “We know she is with the child and where they are. The family court judge has been made aware of the situation.”

In McCready's defense, her publicist said the the country singer simply “took action to ensure her son’s safety," claiming her mother Gayle Inge has created an unsafe environment for the child.
 
McCready has undergone a series of personal woes in the past few years, including a reported suicide attempt, jail time for resisting arrest after a scuffle with her mother, and a battle with addiction that was documented in a season of MTV's "Celebrity Rehab."
 
McCready reportedly had an affair with former Red Sox pitcher Roger Clemens while she was a teenager.
